General terms and conditions

Terms
The following terms are used in these general terms and conditions:

  • Contractor: Senz Interim.
  • Consultant: the consultant appointed by Senz Interim.
  • Client: the institution or the person authorised by the institution as signatory.
  • Workshop/training/event: workshops, training courses and/or events offered by Senz Interim.
  • Working days: a full working week of five working days is assumed.
  • Customer: the client and/or the participant in a training course/workshop.

Quotes and orders

  • The quote is valid until the expiry date stated therein.
  • Amounts referred to in the quote are valid until the expiry date stated therein.
  • By signing the offer, you also agree to the general terms and conditions.
  • All amounts referred to in the quote are exclusive of VAT, unless stated otherwise.

 Acceptance

  • The quote is accepted by means of digital signature on the quote.
  • After signing the quote, the client has an obligation to pay.
  • In the event that the activities as referred to in this quote commence, at the request of the client, before the contract has been returned digitally signed by the client to Senz Interim, this will be regarded as a verbal agreement and the highest applicable rate from the quote will be charged on the basis of subsequent calculation. In that case, the client also has an obligation to pay.
  • The client enters into an agreement with the contractor. The contractor will appoint a consultant for the order.
  • The basic but non-binding principle is that one and the same consultant will undertake the entire order. The contractor remains free, however, to appoint another consultant for the order, without having to state the reasons for doing so. In that case, the contractor is responsible for continuity and the proper transfer of the order.

 Rights and obligations

  • The contractor undertakes to provide the client with the services referred to in the quote.
  • This agreement constitutes a best-effort obligation on the part of the contractor towards the client.
  • This agreement obligates the client to ensure that the consultant has the correct information at his disposal at the time of commencement of the order, or at the latest within ten working days of the start date of the order, and that the consultant can log in to the systems within the institution that are relevant to the order.

 Cancellation of the order

  • The agreement between the client and the contractor is only binding once the client has digitally signed the order.
  • In the event that the activities as referred to in this quote commence, at the request of the client, before the contract has been returned digitally signed by the client to Senz Interim, this will be regarded as a verbal agreement and the highest applicable rate from the quote will be charged on the basis of subsequent calculation. In that case, the client also has an obligation to pay.
  • The contractor reserves the right to suspend or cancel execution of the order if the client fails to make payment or if the client fails to fulfil its obligations as referred to under ‘Rights and obligations’.
  • Suspension or cancellation of the order by the contractor for the reasons referred to above will not release the client from its obligation to pay.

 Invoicing and payment

  • The contractor will compile an invoice on the basis of the hours actually worked at the end of each calendar week.
  • The client will make payment within 30 days of receipt of the invoice.
  • If, at the request of or with the prior consent of the client, the consultant undertakes activities or other performances that are outside the content or scope of the agreed service provision, the client will pay for those activities or performances at the consultant’s standard rates.

Workshops, training courses and events

Registration and cooling-off period

  • Registration for a workshop, training course or event is submitted through the website of Senz Interim.
  • There is a right to cancel the agreement without the need to specify a reason for a period of ten working days after registration for a training course/workshop/event, provided that this period is no less than twenty working days before the start of the training course/workshop/event; in that case, the cancellation rule as referred to under ‘Cancellation of a workshop, training course or event’ applies.

Cancellation of a workshop, training course or event

Cancellation of a workshop, training course or event means cancellation of the registration, failure to participate in workshop/training course/event days (unless there is the option to ‘catch up’ on the workshop, training course or event) or a rescheduling of the start time of the workshop, training course or event by the participant or the institution at which he/she is employed. Senz Interim applies the following cancellation rule:

  • You can cancel without charge, in writing (by e-mail to info@senzinterim.nl), up to twenty days before commencement of the first workshop/training course/event day.
  • In the event of cancellation on or within twenty working days of commencement of the workshop/training course/event day, 50% of the price will be charged.
  • In the event of cancellation on or within ten working days of commencement of the first workshop/training course/event day, 100% of the price will be charged.
  • 100% of the price will be charged in the event of a no-show.

This cancellation rule does not apply if the institution arranges for another employee to participate in the workshop, training course or event. If Senz Interim is unexpectedly unable to hold a workshop, training course or event, no price will be charged and a suitable alternative will be sought.

Catching up on missed workshop/training course/event days

In the event that, during a workshop/training course/event, a participant unexpectedly misses a day (not being the first workshop/training course/event day), Senz Interim may be contacted for a suitable alternative. A catch-up is only possible within six months.

Invoicing and payment 

  • All training, workshop and event costs must be paid within 30 days of receipt of the invoice.

Dealing with queries

  • Questions of an administrative nature or relating to the content of the order/training course/workshop/event will be answered within five working days.
  • Questions that require longer to answer will be answered within five working days with an acknowledgement of receipt and an indication of when a detailed answer can be expected.

Privacy

  • Senz Interim respects the privacy of all participants and clients and ensures that (personal) information that is provided is treated in the strictest of confidence.
  • When registering for one of our services, we ask you to provide certain items of personal data. These data will only be used for the purpose of providing the respective service.
  • Senz Interim guarantees that the (personal) information provided will be treated in strict confidence and will not be disclosed to third parties.
  • All data with which our consultants work as part of orders will be treated in strict confidence and used solely for the respective order.
  • Senz Interim will not disclose (personal) data to third parties or other parties in any way. In the event that this is required for an order to be carried out, the prior (written) consent of the client will be sought.

Complaints

Complaints procedure
Senz Interim considers customer satisfaction the foremost priority.

  • In the event that deficiencies are identified during the execution of an order/training course/workshop, the customer is requested to submit the complaint, accompanied by arguments, to the management of Senz Interim within a period of two weeks of termination of the order/training course/workshop at the latest.
  • Senz Interim will confirm receipt of the complaint in writing within one week.
  • The management of Senz Interim is responsible for handling all complaints.
  • The management of Senz Interim will provide a response within three weeks of receipt. If more time is needed to conduct an investigation, we will inform you of this.
  • In the event that no agreement can be reached between the customer and Senz Interim, the customer may refer to an independent third party; this third party will be selected in mutual consultation and its costs will be borne by Senz Interim.
  • The opinion of the independent third party is binding; any consequences will be handled promptly.

General basic principles for complaints

  • In its complaints procedure, Senz Interim observes all rules and regulations relating to privacy and will handle the complaint with the utmost care.
  • Senz Interim can only handle complaints that have a name, (e-mail) address and date of submission.
  • Senz Interim will send a reasoned assessment of all parts of the complaint submitted, as well as of any measures that Senz Interim has taken or will take in light of the findings.
  • Complaints will be kept on file for at least one year after conclusion.
